Wayne Peart denied he was disqualified.

But police checked and the DVLA website showed Peart’s photograph with information he was banned.

Chef Peart, 34, formerly of Back St Annes Road West, St Annes, now living at Malvern Road, St Annes, pleaded guilty to driving while disqualified without insurance.

He was sentenced to six weeks’ prison suspended for 12 months, ordered to do 60 hours’ unpaid work for the community, told to pay £85 costs with £80 victims’ surcharge and banned from the road for 12 months by magistrates.

Peart had not been present when he had been banned for six months. He had changed address and documentation had not reached him.
